Privacy Policy.

Nemeth McLachlan respects your rights to privacy and data security. This policy explains how we collect personal information, what we do with it, how it is stored and who we might share it with. The Policy also describes how you can access or correct information we hold about you and how you can ask further questions or make a complaint.

Why we collect your information

You will generally be required to identify yourself when you deal with Nemeth McLachlan (such as when you become a client of ours) and provide other types of ‘personal information’ in order for us to assist you and provide you with other services. Personal information may include your name, identity details (such as your title and position and employing entity), contact details and other personal details relevant to the engagement. Without such information, we may not be able to assist you at all or may have to cease providing services to you.

How we collect your information

While we endeavour to collect personal information about you directly from you, to the extent that it is reasonable or necessary, we may also collect your personal information from third parties including your adviser(s), employer (or its affiliates), agents, public sources and service providers (including credit reporting bodies).

We take reasonable steps to be transparent about how and why we collect personal information.

How we use your information

We use personal information about you for the purpose for which it was provided to us, including to:

  • communicate and deal with you or investigate any complaints or enquiries;

  • administer and manage our service and any relevant engagement; and

  • business development including sending legal updates, publications and details of events.

In addition, we may use your personal information to the
extent permitted or required by law.

We may also anonymise your information (including interactions with our website) for our own purposes including market research and new product or service development.

Who do we share your information with

We may share personal information within Nemeth McLachlan, and may disclose personal information outside the Nemeth McLachlan to:

  • any third parties that we engage on your behalf or which you engage directly
     in connection with the services we are providing to you, including barristers, auditors, accountants, third party experts and other consultants or advisors;

  • if our engagement is on behalf of your employing entity, with that entity;

  • our service providers, who provide services in connection with our products and services;

  • our insurers and our professional advisors, including our accountants, business advisors and consultants; and

  • any regulatory body.

With your consent, we may share your personal information to other authorised persons or for other purposes (including marketing of Nemeth McLachlan). We do not sell personal information for marketing purposes to other organisations or allow such companies to do this.

In some circumstances the parties to whom we disclose personal information may operate outside of Australia. Where this occurs, we take steps to protect personal information against misuse or loss and to comply with local law in respect of the transfer of your data from one jurisdiction to another. Those parties, in turn, may make such information available to the governments of such other countries in accordance with local law requirements.

How we store your information

We keep personal information in physical and electronic records, at our premises and the premises of our service providers, which may include processing or storage in the cloud, which may mean in practice that this information is stored outside Australia. We also keep records of our interactions with you (including by telephone, email and online).

We take reasonable steps to protect the security and integrity of personal information from misuse and loss, and from unauthorised access, modification and disclosure.
